Terms & Conditions

These terms and conditions (the “Terms”) apply to the Malfy Gin Amalfi Holiday promotion (the “Promotion”) and will prevail in the event of any conflict or inconsistency with any other communications, including in-store or online advertising or promotional materials including bottle neck collars. Entry instructions are deemed to form part of these Terms. By participating in this Promotion, all entrants will be deemed to have accepted and be bound by these Terms.  Please retain a copy of these Terms for your information.

 

  1. Promoter: Pernod Ricard UK Limited, Building 7 Chiswick Park, 566 Chiswick High Road, London, W4 5YG. Please do not send entries to this address.
  2. The Promotion will be managed Element London Limited (“Element”), on behalf of the Promoter.  Element’s registered address is Unit 9 Featherbed Court, Mixbury, Brackley, NN13 5RN. Please do not send entries to this address.
  3. Eligibility: Promotion open to residents of the United Kingdom (England, Scotland, Wales, and Northern Ireland) aged 18 years and over, except employees and families of the Promoter and its affiliate companies and agencies (including Element) and anyone professionally connected with the Promotion. Excludes residents of the Channel Islands and Isle of Man.
  4. Promotional Period: The Promotional Period shall start at 00:00 on 1st April 2025 and end at 23:59 GMT on 31st August 2025.
  5. Entry Instructions
    1. Entrants must:
      1. purchase any promotional bottle of Malfy Gin 70CL from participating retailers during the Promotional Period; and
      2. head to www.malfygin.com/win, enter the unique code found on the inside of the bottle neck collar or upload a copy of the receipt, as well as the entrants’ name and email address.
    2. Purchase is necessary for all entries. Entrants should retain their original itemised receipt and original neck collar showing the winning unique code as they may need to provide them to claim the Prize (see paragraph 6 and 9.7).
    3. Entrants can purchase multiple promotional products throughout the Promotional Period but can only enter once per product purchased.

      All promotional codes are unique, and each code can only be entered once. Any further attempts to enter the code will result in disqualification.

 

  1. Winner Selection
    The Winner of the Amalfi Holiday will be selected at random by Element, using an automatic computer process from all valid entries on or around 5th September 2025 (the “Winner”). The Winner will then be contacted by Element via email by 19th September 2025 and further details about how to book the Amalfi Holiday will be provided. Where a Winner fails to respond to this email or any other emails received from Element within 10 working days, a new Winner be chosen at random via the same process.

 

  1. The Prize
     
    1. There is one prize of a holiday to the Amalfi Coast (the “Amalfi Holiday”). The Amalfi Holiday is for the Winner and the Winner’s companion.  It includes:
      1. Return flights from major UK airport to Naples.
      2. Return private airport transfers from Naples airport to the hotel accommodation in the Amalfi Coast.
      3. 5 nights’ stay at 4-star hotel accommodation on the Amalfi Coast, based on sharing a double/twin room, with breakfast included. 
      4. Daily evening meal at popular Amalfi’s restaurants, up to the maximum daily value of £100 per person including drinks and gratuity
      5. Private boat tour from the Amalfi Coast to Capri, including, drinks and snacks on board, swimming stops, and entry to iconic Blue Grotto. 
      6. Two-hour guided private sightseeing tour along Amalfi Coast to Ravello, travelling by vintage Fiat 500. 
      7. Local cooking class, includes a welcome drink, pizza making masterclass, drinks, snacks and a traditional homemade dessert.
      8. Full-day private chauffer driven tour of the Amalfi Coast, including a bespoke itinerary of the Winner’s choosing.
      9. £1,000 spending money (to be deposited into the Winner’s bank account).
      10. Winner management.
    2. Further Conditions of the Prize
      1. The Winner and their companion must travel at the same time with the same itinerary. The Winner must be one of the travelling parties.
      2. The Winner of the Amalfi Holiday and their companion must be aged 18 or over.
      3. Economy flights available from major international airport in the UK only. Flights will be selected by the Promoter and not all routings will be available. Travel arrangements (including costs relating to public transport, fuel or parking) to and from the Winner or the companion’s home and the UK departure airport do not form part of the Prize and are the responsibility of the Winner and their travelling companion.  The Promoter will cover the taxes and fees associated with the flights, as well as one checked luggage item per person.
      4. Accommodation is based on two (2) adults sharing one (1) double occupancy room, in the Amalfi Coast only. Accommodation will be selected by the Promoter at their sole discretion. The Winner will need a current and valid credit/debit card with sufficient available funds in order to check in at the hotel for security deposit purposes.
      5. The Promoter may appoint an independent travel agent to book and manage the Prize on its behalf.  Once an itinerary has been agreed, any amendments or anything not expressly included in the itinerary (including any in-flight extras and additional hotel charges) will be at the expense of the Winner.  If a booking is cancelled or a companion removed, no alternative tickets will be issued.  The Prize will be subject to the additional terms and conditions of the booking agent which will be notified to the Winner at the time of booking.
      6. The Amalfi Holiday must be booked and travelled within one year of the Winner receiving their notification email and once booked any amendments will be at the expense of the Winner. The Prize cannot be taken from 21st December – 2nd January (Christmas and New Year), over UK bank holidays or over Easter Sunday. The Winner must contact the Promoter with three preferred travel dates in three separate months no later than six weeks prior to departure.
      7. The Winner and the companion are  responsible for obtaining a current and valid passport and any other relevant travel documentation required for travel to Italy, at their own expense. The Winner and their companion must obtain travel insurance and any required vaccinations, health certificates, visas, and other documentation necessary to complete the itinerary at the time of travel.
      8. In the event of any travel disruptions, including but not limited to the cancellation or rescheduling of flights, or if a companion is removed, no alternative tickets will be issued.  The Promoter accepts no responsibility for arranging alternative transportation or covering any additional costs incurred. It is the sole responsibility of the Winner to make alternative arrangements and bear any associated costs in such circumstances. The Promoter recommends that the Winner obtains adequate travel insurance to cover these sorts of events.
      9. All cash allowances listed will be sent via bank transfer to the Winner’s nominated account.
      10. The Prize excludes domestic ground transfers, meals and drinks not explicitly mentioned in these Terms, hotel incidentals, excursions, attractions, treatments, visas, personal expenses and anything not expressly stated in these Terms.
      11. Specific terms and restrictions may apply for the activities listed and will be provided upon booking.
      12. All elements of the Prize are subject to availability.  If all or any part of the Prize is unavailable, the Promoter may, in its absolute discretion, substitute all or any part of the Prize for an alternative Prize of equal value.
      13. The Prize is non-transferable and no cash alternative will be offered for the Prize (including if the Winner goes on the Amalfi Holiday alone).
    3. For the avoidance of doubt, the Amalfi Holiday will be forfeited if the Winner:
      1. is unable to take the Prize within the dates specified by the Promoter;
      2. has not obtained the proper travel documents by the date specified by the Promoter;
      3. has any immigration complications which prevent them from entering, leaving, or travelling within the dates specified by the Promoter;
      4. has any medical, legal or any other reason that would prevent them from accepting or participating in the Amalfi Holiday;
      5. for any other reason as set out in these Terms; or
      6. if the Promoter, in its sole discretion, determines that awarding the Prize would be unsafe, impractical, or otherwise inappropriate for any reason not specifically mentioned herein.
    4. In the event that the Amalfi Holiday is forfeited by the Winner, a new Winner will be chosen at random in accordance with these Terms.

 

  1. Personal Data​​​​​​​
    1. Personal data which is provided by entrants on entering the Promotion will be processed and stored in a database by Element for the purpose of managing entry into the Promotion on the Promoter’s behalf. By providing personal information, entrants consent to the processing and storage of personal information by Element for this purpose. Element’s privacy policy is available here.
    2. All personal data will be deleted within 30 days of the date when the Amalfi Holiday ends. Consents can be withdrawn or amended at any time by emailing  team@element-london.com. If an entrant withdraws consent to the storage and processing of their data for the purposes of administering the Promotion, they will also be withdrawn from the Promotion itself.
    3. In the event that a reasonable request is made, including by the Advertising Standards Authority or any other competent body, Element will provide the surname and county of residence of the Winner of the Amalfi Holiday.
       
  2. General
    1. The Promoter accepts no responsibility for entries or claims for the Prize that are lost, delayed, or damaged for any reason whatsoever.
    2. Incomplete entries or those not in accordance with the entry instructions will not be accepted.
    3. Entrants agree that, to the extent permissible by law, the Promoter, its affiliates and agents assume no liability for injuries, losses or damages or any kind to property or persons, including without limitation death, resulting in whole or part, directly or indirectly, from the management of or mechanics behind the Promotion, entry into the Promotion, the acceptance of the Prize, and any acts or omissions of the Winner and their companion.  Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligence.
    4. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this Promotion or the awarding of the Prize, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the Promotion or these terms and conditions, at any stage, but will always endeavour to minimise the effect to the entrants in order to avoid undue disappointment.
    5. The Promoter reserves the right to exclude any entries that it reasonably believes to be fraudulent or based on misconduct.
    6. The Promoter (or Element on the Promoter’s behalf) reserves the right to verify all entries including but not limited to asking the Winner for proof of purchase and address and asking the Winner and their companion for age and identity details (which they must provide within 10 working days) and to refuse to award the Prize or withdraw entitlement to the Prize and/or refuse further participation in the Promotion and disqualify the entrant or Winner where there are reasonable grounds to believe there has been a breach of these Terms or any instructions forming part of these Terms or otherwise where an entrant has gained unfair advantage in participating in the Promotion. The Promoter will be the final arbiter in any decisions, and these will be binding and no correspondence will be entered into in relation this clause.
    7. These Terms (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with English law. Entrants hereby irrevocably submit to the exclusive jurisdiction of the English courts to settle any such dispute or issues.
